Despite initial police recommendations, the Maricopa County Attorney’s Office has determined there is “no likelihood of conviction” against Brady, bringing some relief to the family in this incredibly painful time.

However, after reviewing the case, the Maricopa County Attorney’s Office confirmed on July 25, 2025, that the evidence presented did not meet the legal standard for a conviction.

According to the office, the case was carefully evaluated by senior attorneys, and the conclusion was made that the drowning incident, which occurred on May 12, 2025, was indeed a tragic accident, not an act of negligence or abuse.

Emilie Kiser’s attorney, Flynn Carey, expressed gratitude for the investigation’s thoroughness and the decision not to pursue charges. In a statement, Carey said, “Brady remains in the grieving process and is thankful to be with his family as they heal together.”

On May 12, 2025, Trigg Kiser’s drowning occurred in the family’s backyard pool. Brady was home at the time, looking after Trigg and their newborn son, Theodore. He later explained to authorities that he lost sight of Trigg for about three to five minutes while caring for the infant.

Tragically, when Brady returned to the yard, he discovered Trigg floating in the pool. Trigg was rushed to the hospital and passed away six days later, on May 18.
